Legal Limits of THC in CBD

Legal, Compliant, Hemp Derived CBD has a Legal Limit of 0.3% THC

The legal limit for THC (tetrahydrocannabinol) in CBD (cannabidiol) products in the United States is 0.3% or less on a dry weight basis, according to the 2018 Farm Bill. This legislation legalized hemp, which is defined as cannabis that contains no more than 0.3% THC by dry weight. CBD products derived from hemp must also contain less than 0.3% THC to be legal under federal law.

The 0.3% THC limit applies to all hemp-derived CBD products, including CBD oil, tinctures, capsules, gummies, topicals, and other products. It is important to note that this limit only applies to products derived from hemp, not marijuana. Marijuana-derived CBD products are still considered illegal at the federal level, although some states have legalized marijuana for medical or recreational use.

The 0.3% THC limit is enforced by the U.S. Department of Agriculture (USDA), which regulates hemp production, and the U.S. Food and Drug Administration (FDA), which regulates CBD products marketed as dietary supplements or for therapeutic use. CBD products that exceed the legal limit of THC may be considered marijuana under federal law and subject to seizure and legal action.

In addition to the federal regulations, some states have additional regulations or restrictions on THC levels in CBD products. For example, some states may have lower THC limits, or may require testing and labeling to ensure that products contain less than the legal limit. It is important for consumers to be aware of the legal limit for THC in their region when purchasing and using CBD products.
